Terms of Service

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use Motionary. You may create an account by signing in through a supported provider such as Google or GitHub.

You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Provide accurate information, keep it up to date, and notify us promptly of any unauthorized use. You may not share your account, impersonate others, or create an account on behalf of someone else without authorization.

Motionary is a platform that connects creators (“sellers”) who publish digital animation components and assets for React Native with users (“buyers”) who license them. Motionary is the marketplace and payment facilitator; it is not the author of seller content and is not a party to the underlying license between a buyer and a seller except as set out in these Terms.

When you purchase an item on Motionary — and subject to your payment clearing and your compliance with these Terms — the seller grants you a non-exclusive, worldwide, perpetual, non-transferable license to use, reproduce, and modify the purchased asset solely to build and distribute your own applications and projects.

Unless an item’s listing expressly states otherwise, you may not:

• resell, redistribute, sublicense, or share the asset (or any minor modification of it) as a standalone file, template, or competing product;
• make the asset available for others to download or extract outside of your compiled application;
• claim authorship of the asset or remove proprietary notices.

Some items may carry their own license terms set by the seller; where those terms grant additional rights or impose stricter limits, they apply to that item. A license is granted to you and may not be transferred except as part of a sale of the application in which the asset is embedded.

Prices are shown at checkout in the listed currency and may exclude applicable taxes, which you are responsible for. Payments are processed by Stripe; by purchasing, you authorize us and Stripe to charge your selected payment method, and you agree to Stripe’s terms in addition to ours.

Motionary sells digital goods — source code and animation components that are delivered and made available for download the moment your purchase completes, and that you can copy and keep even if you later remove them. Because you receive immediate access to the code, all sales are final and payments are non-refundable once an item has been delivered to you. By purchasing, you consent to that immediate delivery and acknowledge that it is the reason refunds are not available.

This does not affect any rights you have under applicable law that cannot be waived, and we will still review a purchase that is materially defective or not as described. If you believe a purchase qualifies, contact us at [email protected] and we will review it in good faith.

If you publish items as a seller, you represent and warrant that you own or have all rights necessary to license the content you upload, that it does not infringe any third party’s intellectual property, privacy, or other rights, and that it does not contain malicious code.

You grant Motionary a non-exclusive, worldwide license to host, store, reproduce, display, market, and distribute your content for the purpose of operating and promoting the marketplace and delivering it to buyers you have authorized. You set your prices (within any limits we publish) and grant buyers the license described above.

Payouts are made through Stripe Connect. To receive payouts you must complete Stripe’s onboarding and provide accurate identity and banking information; payouts are subject to Stripe’s terms, verification, and timing. Motionary retains a commission and/or fees on each sale as disclosed at the time of listing or in your seller dashboard; the remainder, net of applicable taxes and adjustments such as refunds or chargebacks, is paid out to you.

You agree not to misuse Motionary. Among other things, you may not:

• upload or distribute content that is unlawful, infringing, deceptive, malicious, or that you do not have the right to share;
• upload malware, or attempt to gain unauthorized access to the service, other accounts, or our systems;
• scrape, harvest, or bulk-download content except as expressly permitted;
• interfere with or disrupt the integrity or performance of the service;
• circumvent fees, manipulate rankings or reviews, or engage in fraudulent transactions;
• use Motionary to violate any applicable law or the rights of others.

Motionary and its original content, features, branding, and software — excluding content uploaded by sellers — are owned by Motionary Inc. and protected by intellectual property laws. These Terms grant you no right to use our name, logos, or trademarks without our prior written permission. Seller content remains the property of the respective sellers, subject to the licenses granted in these Terms.

We respect intellectual property rights and expect our users to do the same. If you believe content on Motionary infringes your copyright, send a notice to [email protected] identifying the work, the location of the allegedly infringing material, and your contact information, together with a statement of your good-faith belief that the use is unauthorized and a statement, under penalty of perjury, that you are authorized to act. We may remove infringing content and terminate the accounts of repeat infringers.

You may stop using Motionary and delete your account at any time. We may suspend or terminate your access — with or without notice — if you breach these Terms, create risk or legal exposure for us, or engage in fraudulent or harmful conduct. On termination, licenses you have validly purchased survive in accordance with their terms, while your right to access the service ends. Provisions that by their nature should survive — including intellectual property, disclaimers, limitations of liability, and indemnification — will survive.

Motionary is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any asset will meet your requirements. You use marketplace content at your own risk and are responsible for evaluating its suitability for your projects.

To the maximum extent permitted by law, Motionary Inc. and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of Motionary. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid to Motionary in the three months before the event giving rise to the claim, or USD 100.

You agree to indemnify and hold harmless Motionary Inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the service, your violation of these Terms, or your violation of any law or third-party right.

These Terms are governed by the laws of Türkiye, without regard to its conflict-of-laws rules. You agree that the courts located in Istanbul, Türkiye will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service, except where applicable law gives you the right to bring proceedings in your local courts.

We may update these Terms from time to time. When changes are material, we will update the “Last updated” date above and may provide additional notice. Your continued use of Motionary after the changes take effect constitutes acceptance of the revised Terms.
